These Terms and Conditions (“Terms”) govern your use of the Zade by Design website at www.zadebydesign.com (“Website”) and the purchase of products through it. By accessing this Website or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use this Website.
Zade by Design (Pty) Ltd is a private company registered in South Africa under registration number 2022/677124/07. For enquiries, contact zadebydesign@gmail.com or +27 73 806 3424. Our products are manufactured and sold under the “Because I Care” range.
3.1 We make every reasonable effort to ensure that product descriptions, images and pricing are accurate. However, errors may occasionally occur.
3.2 Product images are for illustrative purposes only. Colours, packaging and appearance may vary slightly from those shown.
3.3 We reserve the right to modify, discontinue or withdraw any product without prior notice.
4.1 By placing an order, you make an offer to purchase the selected products at the displayed price.
4.2 An order is only accepted once payment has been successfully received and we have confirmed or dispatched your order.
4.3 We reserve the right to refuse, cancel or limit any order at our sole discretion, including where products are unavailable, incorrectly priced or where fraudulent activity is suspected.
4.4 Once your order has been accepted, you will receive an order confirmation email.
5.1 All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
5.2 Payment must be made in full before any order is processed.
5.3 Payments are securely processed through our authorised third-party payment provider. We do not store your payment card information.
5.4 We reserve the right to correct pricing errors before accepting an order.
6.1 We currently deliver within South Africa.
6.2 Delivery costs are displayed during checkout before payment is completed.
6.3 Estimated delivery times are provided for convenience only and are not guaranteed. Delays caused by couriers or events beyond our reasonable control do not make us liable for any losses.
6.4 Risk in the products passes to you upon delivery.
6.5 If delivery cannot be completed because no one is available to receive the parcel, the courier may arrange re-delivery or return the parcel. Additional delivery charges may apply.
7.1 Your rights under the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) remain unaffected by these Terms.
7.2 If you change your mind after purchasing online, you may have certain cancellation rights under applicable South African law, subject to any legal exceptions and the goods being returned unused, unopened and in their original condition.
7.3 If a product is defective, damaged or does not meet the standards required by the CPA, you may be entitled to a repair, replacement or refund in accordance with the CPA.
7.4 To request a return, refund or exchange, please contact us at hello@zadebydesign.com with your order number and details of the issue.
7.5 Where a product is returned for reasons other than a defect, it must be unused, unopened and in its original packaging.
7.6 Approved refunds will be processed to the original payment method within a reasonable period after the returned product has been received and inspected.
7.7 Opened or used products cannot be returned unless they are defective or the return is otherwise required by law.
8.1 Our products are intended for cosmetic hair care purposes only and are not intended to diagnose, treat, cure or prevent any medical condition.
8.2 We recommend performing a patch test before first use, particularly if you have sensitive skin or known allergies.
8.3 Discontinue use immediately if irritation occurs and seek medical advice where appropriate.
8.4 Please follow all instructions provided with the product.
All content on this Website, including but not limited to text, images, graphics, logos, product names, trademarks, designs, packaging, photographs and product descriptions, is the intellectual property of Zade by Design (Pty) Ltd or its licensors. No content may be copied, reproduced, distributed, modified, published or otherwise used without our prior written permission.
You agree not to:
11.1 To the fullest extent permitted by South African law, Zade by Design (Pty) Ltd shall not be liable for any indirect, incidental, consequential or special damages arising from your use of the Website or the purchase of our products.
11.2 Our total liability in relation to any claim shall not exceed the amount paid by you for the relevant product.
11.3 Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under the Consumer Protection Act or any other applicable South African law.
While we strive to keep the Website available at all times, we do not guarantee uninterrupted, secure or error-free access. We may suspend or withdraw the Website temporarily for maintenance, updates or other operational reasons.
We shall not be responsible for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, floods, fires, power outages, strikes, pandemics, courier delays, government actions or failures of telecommunications networks.
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or the use of this Website shall be subject to the jurisdiction of the South African courts.
We reserve the right to amend these Terms at any time. Any changes will be published on this page with an updated revision date. Continued use of the Website following any changes constitutes acceptance of the updated Terms.
